Please read carefully the conditions below, and print and/or save them on other durable media of your choice. This website (hereinafter the "Site") is the property of Ischia Spaeh S.r.l., with registered office in Ischia (NA) Italy, at Via Nuova Cartaromana, 111, tax code, and registered in the Register of Companies of Naples as No. 06956161217, REA Naples No. 851619 and dedicated to retailing to the subjects identified by the data entered when completing the registration form (hereinafter referred to as "Customer"). Ischia Spaeh S.r.l. observes the law on distance selling (Legislative Decree 185/99).

General conditions

These general terms and conditions of sale are the only ones applicable and replace any other terms, unless otherwise agreed in writing.

Ischia Spaeh S.r.l. reserves the right to modify these general conditions of sale; you must read it before placing an order at www.ischiaspaeh.it. Such modifications shall be immediately enforceable against the Customer as of their publication, and shall not apply to contracts concluded earlier. Ischia Spaeh S.r.l. considers that, by confirming their order, the Customer has read and accepted without reservation all these general terms of sale. Shipping and payment methods are listed in detail in the relevant sections and are considered to be an integral part of this contract. The privacy terms are listed in the relevant section and are also considered to be an integral part of this contract.

Registering on the site

Orders can only be made after the customer has registered correctly on the Site. By accepting the conditions via the order form, the Customer acknowledges that they have observed all the information provided to them during the order process and accepts in full the general conditions of sale.

The contract between Ischia Spaeh S.r.l. and the Customer must be considered concluded when the Customer's submitted order reaches the databases of the Site.

Purchase procedure

The Customer can only purchase the products available in the catalogue of the Site at the time of submission of the order, as described in the relevant technical data sheets. The order cannot be made if the products are shown as unavailable. In any event, the products on the Site are featured until no longer available. The images alongside the product description box may not be fully representative of the product's features. Products may differ in colour or by accessories shown in the picture. Technical information supporting purchase is provided directly by Ischia Spaeh S.r.l. and must be considered material for general information.

Acceptance of the Order

The order sent by the Customer will be binding for Ischia Spaeh S.r.l. only if the entire order process has been duly completed and without any error messages from the Site.

Ischia Spaeh S.r.l. shall not be held liable for malfunctions dependent on the data transmission network operator. Before proceeding to order submission, the Customer may identify and correct any errors in entering their personal details and/or address or number of products.

The Customer will receive an order confirmation in their email inbox, with a summary of the products, their relative prices and the general and particular conditions pertaining to the order itself.

Sales Prices on the Site

All prices stated on the Site include VAT. Prices are net of shipping costs and any discounts with promotional codes.

Ischia Spaeh S.r.l. reserves the right to alter sales prices at any time and without notice of any kind.

Billing

For each order, a regular commercial invoice can be issued that the Customer will find in the appropriate section of their personal page and therefore it is necessary/mandatory to indicate their VAT number.

Right of withdrawal and product returns

The Customer has the right to terminate this Agreement without any penalty and without specifying the reason within ten working days from the day of receipt of the product by sending a request via the form on the page Returns Policy or by sending an email to the following address: team@ischiaspae.it.

The right of withdrawal is exclusively granted to the client who is "consumer" in accordance with and for the purposes of Legislative Decree no. 185/1999.

The Customer, who has exercised the right of withdrawal in the manner and in the terms of the preceding article, is required to return the goods "intact" as they were delivered and to return them within ten days of the exercise of the right of cancellation with shipping charges at their own expense.

When the Customer exercises the right of withdrawal, Ischia Spaeh S.r.l. is obliged to refund the payment received for the products and the shipping costs within ten working days after the shipment of the products returned by the Customer.

Security of payment

Purchases made on the site ischiaspaeh.it are safe and secure.

Online payment by credit card is completely secure. Payment information is encrypted while being transmitted and is managed directly by Banca Sella. In no case shall Ischia Spaeh S.r.l. know the credit card number, nor will it handle or retain the data provided on its systems. The Company will only be notified of the positive outcome of the transaction.

Security certificate

To ensure maximum security in purchases, payment information over the internet is encrypted by the Secure Socket Layer (SSL) protocol.

Payment methods

We accept the following payment methods:

  • Bank Transfer Paid in Advance: In case of payment by bank transfer in advance, execution of the delivery of the order ordered by the Client will be suspended until the payment of the amount due in the bank account of Ischia Spaeh S.r.l.   • Payment by PayPal: is a secure online payment system that requires the opening of an account at PayPal.
  • Payment by credit or debit card: We accept Visa, MasterCard, PostePay, American Express, Visa Electron, other prepaid credit cards.

Delivery

For deliveries to the address indicated by the Customer, Ischia Spaeh S.r.l. uses the private carrier SDA or other express courier. Please refer to the specific section for more information.

Fidelity Points

To reward your purchasers we have created FIDELITY POINTS that allow you to accumulate scores that you can use as good discounts for future purchases. You just need to enter your reserved area and you will be able to see in real time your accumulated punts that you can use at your next purchase.

Force Majeure

Ischia Spaeh S.r.l. shall make every effort to comply with its obligations. However, the Company may not be held responsible for delays or non-delivery caused by circumstances outside its reasonable control. Such circumstances include strikes, wars, natural disasters, and any other event that makes production, transport, or delivery impossible.

Competent Court

These Conditions of Sale are governed by Italian law. For issues not specifically addressed in these Conditions, Legislative Decree 185/99 "Implementation of Directive 97/7 / EC regarding the protection of consumers in respect of distance contracts" shall be referred to. For any disputes concerning these Conditions or the sale of the products, the Court of Naples will have jurisdiction.
